Terms of Service

The rules for using Sundream, creating accounts, managing content, and generating AI video.

Agreement to these Terms

These Terms of Service govern your access to and use of Sundream, including our website, application, AI-assisted creative tools, team workspaces, APIs, generated media workflows, and related services.

By creating an account, joining a workspace, or using the service, you agree to these Terms. If you use Sundream for an organization, you represent that you have authority to bind that organization.

Eligibility and accounts

  • You must be at least 18 years old, or the age of majority where you live, unless Sundream approves a different arrangement in writing.
  • You are responsible for account activity, credentials, team invitations, and permissions granted under your account.
  • You must provide accurate account information and promptly update it when it changes.
  • You must notify us if you believe your account or workspace has been compromised.

Your content

You retain ownership of scripts, prompts, files, images, videos, characters, references, project notes, and other content you submit to Sundream, subject to any third-party rights and applicable law.

You grant Sundream a limited license to host, copy, process, transmit, display, modify, and create technical derivatives of your content only as needed to provide, secure, support, and improve the service; comply with law; and enforce these Terms.

Generated outputs

Subject to these Terms, any applicable plan terms, and third-party provider restrictions, you may use generated outputs for your personal or commercial projects. You are responsible for reviewing outputs before publishing or distributing them.

AI outputs may be similar to outputs generated for other users, may contain errors, and may not be protectable by copyright in every jurisdiction. Sundream does not guarantee originality, exclusivity, legal clearance, or fitness for a particular use.

Third-party services

Sundream may rely on third-party providers for authentication, storage, databases, hosting, payments, analytics, AI models, and media generation. Your use of features powered by those providers may be subject to their terms, policies, and technical limits.

Acceptable use

  • You may not use Sundream to violate law, commit fraud, compromise systems, create malware, bypass security controls, or evade usage limits.
  • You may not create, request, upload, or distribute child sexual abuse material, sexual content involving minors, non-consensual intimate imagery, or sexualized depictions of real people without consent.
  • You may not use realistic AI media to impersonate a person, brand, public figure, or organization in a deceptive or harmful way.
  • You may not use the service for targeted harassment, threats, doxxing, hate, extremist activity, or discriminatory high-impact decisions.
  • You may not upload or generate content that infringes copyright, trademark, publicity, privacy, contractual, or other rights.

Subscriptions, billing, and changes

If paid plans are enabled, fees, credits, usage limits, renewal terms, taxes, and cancellation rights will be shown at checkout, in an order form, or in your account settings. Unless stated otherwise, fees are non-refundable except where required by law.

We may add, modify, suspend, or discontinue features, models, limits, or pricing. We will provide notice when changes materially affect paid plans or legal rights.

Beta features

Some features may be marked alpha, beta, experimental, preview, or playground. These features may be incomplete, change without notice, produce unexpected results, or be discontinued.

Sundream intellectual property

Sundream and its software, interface, workflow design, documentation, brand, logos, and underlying technology are owned by Sundream or its licensors. These Terms do not grant you ownership of Sundream technology or brand assets.

Copyright and rights complaints

If you believe content available through Sundream infringes your copyright, trademark, publicity, privacy, or other rights, contact support@sundreamstudio.com with enough information for us to identify the material, understand the rights at issue, and contact you. We may remove content, disable access, suspend workspaces, or terminate repeat infringers where appropriate.

Termination

You may stop using Sundream at any time. We may suspend or terminate access if you violate these Terms, create risk, fail to pay fees when due, or use the service in a way that could harm Sundream, users, third parties, or the public.

Disclaimers

Sundream is provided as is and as available. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, and accuracy.

Limitation of liability

To the fullest extent permitted by law, Sundream will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid to Sundream for the service in the 12 months before the claim or 100 U.S. dollars.

Indemnity

You will defend, indemnify, and hold harmless Sundream from claims arising from your content, generated outputs you publish or distribute, your misuse of the service, your violation of these Terms, or your violation of law or third-party rights.

Governing law and disputes

Unless a separate written agreement says otherwise, these Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. Courts located in Delaware will have exclusive jurisdiction, except where applicable law requires another forum.
